Members of the Anti-corruption Council and the public understood the reasons for concealing the results of open tenders by the utility company.
Municipal enterprise "Misky magazin" is one of several hundreds that work in Kyiv. The enterprise is subordinate to the Department of Industry and Entrepreneurship Development of the KMDA. The enterprise is engaged in the retail trade of books in specialized stores, and its office is located in the same premises as the legendary capital bookstore "Syaivo".
This KP has already become involved in a scandal in the past. Thus, according to the results of the company's audit for 2015, violations amounting to UAH 4,7 million were found.
Members of the Anti-Corruption Council draw attention to the work of the "City Store" in connection with a letter from the public organization "Kyiv City Committee for Business Rescue", which stated the facts of the utility company's concealment of information regarding the final price of bids for the placement of means of mobile trade.
At the meeting of the working group of the Anti-corruption Council, both representatives of the public who addressed this letter, as well as representatives of the KP and the Department of Industry and Entrepreneurship Development of the KMDA were invited.
During the discussion, it turned out that the KP, based on an internal order, does not provide information about the results of the tenders in terms of whether a contract was actually concluded based on the results of the tender for the amount offered by the company - the winner of the tender. The representative of KP, the deputy director of the company Ayder Malla, explained such a decision of the management to the desire to preserve commercial secrecy and the requests of the entrepreneurs themselves, who participate in the contests. However, he could not say who exactly and in what form applied to the KP with requests to hide information.
According to members of the working group, such a decision of the KP leadership contradicts the order of the KMDA No. 300 and the norms of the law on public information, and the KP management cannot by its decisions limit citizens' access to information of public interest, especially information about the work of the KP, which was created with funds territorial community.
Instead, in the opinion of Vitaly Pechulyak, director of the Department of Industry and Entrepreneurship Development of the KMDA, who was also present at the meeting, access to information is a right of the public, but its implementation should take place in such a way that it would not contradict the rights of entrepreneurs.
As a result of a lively discussion, the participants of the meeting decided to contact the Department and the KP with a request to provide a comprehensive answer to the publication of information about the final price of the auction.
Since the members of the Anti-Corruption Council also indicated the possibility and necessity of the "City Store" KP through the ProZorro.Sale electronic system, the working group decided to address the relevant proposal to the mayor.
The Office for the Prevention and Detection of Corruption of the KMDA will be connected to the process, which should verify the facts announced at the meeting about the non-inclusion of individual entrepreneurs in the list of those who must pay share participation. Corresponding appeals will also be sent to the Kyiv City Mayor and the Department of Internal Financial Control and Audit with a request to conduct an inspection of KP "City Store".
